Estate, inherited property and divorce sales

For families selling a home in Louisville, Kentucky or Southern Indiana under circumstances nobody chose. Handled quietly, documented carefully, on your timeline.

Who has the authority to sell an inherited house?

Whoever holds legal authority over the property — an executor or personal representative appointed by the court, a trustee under a trust, or every heir already on title, signing together.

The estate attorney confirms which of those applies before we list, so nothing has to be unwound after a contract is signed.

In Kentucky the will is probated in the District Court of the county where the person lived, and the court's order appoints the executor. In Indiana the estate opens in circuit court, and the court grants either unsupervised administration — where the personal representative can sell real estate without a separate court order — or supervised administration, where each sale needs court approval. Which one applies decides how quickly a house can be listed.

How long does probate take before the house can be sold?

Weeks for an uncontested estate where the will grants a power of sale, and many months when the estate is contested or authority still has to be established. Which one you're in is usually clear from the will and the court file before anything is listed.

A Kentucky estate stays open at least six months so creditors can present claims, with final settlement filed after that and generally within two years. In Indiana, creditors have three months from the first published notice, and an unsupervised estate files its closing statement within a year. None of that holds up a sale — once authority is established, a house can be listed and closed long before the estate is settled.

Preparation does not have to wait for the court: sorting, cleanout and a pricing opinion can all happen while authority is being established.

Should an inherited house be cleaned out or renovated before listing?

Remove personal property and anything hazardous, then stop — heavy renovation on an estate property is rarely recovered, and this buyer pool expects to do work.

I can refer estate-sale companies and cleanout crews, and I will tell you plainly when a proposed repair will not pay for itself.

What happens to the house in a divorce?

One spouse buys the other out, the home is sold and proceeds divided under the agreement, or one spouse occupies it temporarily under a court order — the decree or settlement controls the outcome.

Kentucky and Indiana divide property differently, which matters when the house is on the other side of the river from your attorney. Kentucky assigns each spouse their non-marital property first, then divides the marital property in just proportions — there is no presumption of a 50/50 split. Indiana puts everything into one pot, including property either spouse owned before the marriage or inherited, and starts from a rebuttable presumption of an equal division. Your decree or settlement controls either way, and your family law attorney tells you which framework your case is in.

How do you handle communication when both spouses are on title?

Every update, document and offer goes to both parties at the same time, in writing, with attorneys copied where they ask to be.

Showings, feedback and negotiation stay factual. Neither party learns something about their own sale from the other party.

Do all heirs have to agree to sell?

If title already passed to multiple heirs as co-owners, yes — every owner on title must sign, and the estate attorney advises on the remedy when they cannot agree.

Where the property is still held by the estate, the personal representative signs instead of the individual heirs.
